Transfer of Data to the United States

ARC is located in the United States, and many of its members, participants, events, and projects are located in different countries. The Site is hosted in the United States. All Personal Data that we collect and maintain will also be processed and stored in the United States, where data protection and privacy regulations may provide different levels of protection compared with your jurisdiction.

Whenever ARC transfers personal data from one country to another, we will do so in compliance with applicable privacy and data protection law, and we will take reasonable steps to safeguard the privacy of your Personal Data.  These steps may include implementing standard contractual clauses where recognized by law, obtaining your consent, or other lawful means of transferring personal information.

Anonymous Information

Some Voluntarily Submitted Data is provided to ARC anonymously, such as non-identifiable assessment inputs.  This anonymous information is stored anonymously in perpetuity, and as a result cannot be re-identified or deleted upon request.

Third Party Sharing

Third Party Service Providers.  To support certain functions on the Site, we use third-party service providers, such as hosting providers, data management companies, address list hosting companies, e-mail service providers, analytics companies, and other partners in connection with your use of the Site. This often means sharing Automatically Collected Data with those third-party service providers.  For example, a third-party service provider may support a specific web tool on the ARC site even though that tool is actually on the website of the third-party service provider. In most cases, even when a third-party service provider tool is embedded in the Site, we will ensure that the third-party does not have access to Voluntarily Submitted Data.  To support our risk assessment tool, protection services, and other services, third-party service providers may have access to Voluntarily Submitted Data in order to perform technological services for ARC.  In such cases, ARC will ensure that such third-party services providers have executed confidentiality agreements at least as protective as the protections set forth in this Privacy Policy.

Protection Referrals, Emergency, Financial Assistance. A core part of ARC’s work is connecting artists with trusted partner organizations and other service providers that may be able to assist them. In some cases, this requires sharing relevant Voluntarily Submitted Data with the artist’s knowledge/consent. In other cases, we may provide Voluntarily Submitted Data when ARC provides emergency or other financial assistance.  Depending on the circumstances, we may need information required to process a grant/payment and may need to provide necessary information to third-party financial or payment service providers.

Except as described in this Privacy Policy, we will not sell or share your Voluntarily Submitted Data to any third-party unless we first notify you and require your consent to such use.  If you do give consent, you may withdraw it at any time by contacting us (see “How to Contact Us” section below); however, please be aware that such withdrawal will not affect the lawfulness of Personal Data collected and processed prior to the date of your withdrawal of consent. In addition, if you withdraw your consent, you may also forfeit other benefits, such as participation in ARC projects or programs. Any time a third-party service provider’s data collection, use, or security practices differs from the data collection and use practices described in this Privacy Policy, we will let you know and, if possible, provide a link to that third-party service provider’s privacy policy. In special circumstances, we may disclose and use Voluntarily Submitted Data when it is necessary to enforce our Terms of Use or this Privacy Policy, or when we believe that the law requires us to disclose your Voluntarily Submitted Data to third parties.

How Will We Use Your Data

The Voluntarily Submitted Data we collect about you is stored on a secure, password protected server and only authorized personnel have access to your information. We use industry-standard encryption technologies with respect to the receipt and transfer of Voluntarily Submitted Data you submit to us and only authorized personnel have access to your information. Nevertheless, despite our best efforts, no transmission over the Internet and no data storage method can be guaranteed to be 100% secure and we will not be responsible for any damage that results from a security breach of data or the unauthorized access to or use of information.

How Long Will We Keep Your Data?

We keep different types of information for different periods of time, depending on how long we need to retain it in order to provide you with ARC services, to comply with our legal requirements and for safety and security reasons. For example:

  • We keep your account information, such as your user name, password and email address until you ask us to delete it. We cannot provide you with the ARC services without retaining this information.
  • We will retain Voluntarily Submitted Data indefinitely, unless you ask us to delete it, or we determine that a different retention period is required due to the amount, nature and sensitivity of the Voluntarily Submitted Data, legal requirements, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the Voluntarily Submitted Data and whether we can achieve those purposes through other means.
  • Some of the Personal Data will be retained indefinitely to support ongoing research, historical trend analysis, organizational reporting, and future service offerings.
  • We may need to keep certain information longer than our policies specify in order to comply with legal requirements and for safety and security reasons.

What Are Your Data Protection Rights?
